SECTION 4 – REQUIREMENTS FOR REGISTERED USER STATUS

Acquiring registered user status allows navigation through restricted areas of the website, use of services that require prior identification, and the purchase of SOMECHIC products offered through it.

Persons of legal age with full legal capacity to contract who accept these General Terms and Conditions may acquire registered user status. By registering, the user expressly and unreservedly accepts all the terms of these General Terms and Conditions, which they acknowledge having read and understood prior to acceptance. Registration is an essential requirement for contracting SOMECHIC services or purchasing products through the online store.

The username and password generated, which allow the user to identify themselves and use the service, are strictly personal and confidential. The user is responsible for maintaining their confidentiality. Accordingly, the user expressly agrees that we may presume that any use of the service using their login credentials has been made by the registered user, unless the loss or theft of such credentials has been previously reported.

The user may freely change their password using the procedures established for that purpose. The replaced password will be invalid as an identification method once the new one is generated.

We may block access to and use of the website whenever deemed necessary for security reasons. The service will automatically be blocked after three consecutive failed login attempts.

We will take the necessary organizational and technical measures in our systems to ensure the proper use of the service by users and to prevent unauthorized access or disclosure of users’ financial information accessible through the service.

• Not engage in any activity that disrupts or interferes with the operation of the services included on the website.
• Pay for SOMECHIC products purchased through the website and for shipping and handling fees, if applicable.

Therefore, by using this website, you agree that most of our communications with you will be electronic. We will contact you by email or provide you with information by posting notices on this website. This condition does not affect your statutory rights. We may send you communications either by email or to the postal address you provided when placing an order. It will be understood that notifications have been received and properly made at the moment they are posted on our website, 24 hours after an email has been sent, or three days after the date a letter was mailed.

SECTION 7 – CONTRACT WITH SOMECHIC AND ORDER ACCEPTANCE

The content of our website constitutes an invitation to do business. No contract exists between you and us until your order has been accepted by us (even if it has already been charged to your account). If your order is not accepted but a charge has been made, the full amount will be refunded.

After clicking “Buy,” you will receive an acknowledgment email. This does not mean that your order has been accepted, as it is merely an offer from you to make a purchase. Orders are subject to verification and acceptance. We will confirm acceptance by sending you an email notifying you that your order has been shipped (“Shipping Confirmation”). Only then will a binding contract exist between you and us.

Only the SOMECHIC products listed in the Shipping Confirmation will be included in the contract. We are not obliged to supply any other products that may have been part of your order until we confirm shipment of those items in a separate Shipping Confirmation.

The contract with SOMECHIC may be concluded in Spanish or English, at the user’s choice.

SOMECHIC may refrain from processing orders that do not present sufficient solvency guarantees, are incomplete or incorrect, or if SOMECHIC products are unavailable — without liability to you or third parties. In any such case, we commit to informing you, and if we have already charged your account, we will refund the amount paid.

SECTION 8 – PRODUCT RETURN POLICY

You may withdraw from the contract within fourteen (14) calendar days from the date you or a third party indicated by you (other than the carrier) obtained physical possession of the goods. In the case of orders containing multiple goods delivered separately, the 14-day period will begin when you or a designated third party obtains possession of the last item.

In the event of withdrawal, SOMECHIC will refund all payments received from you, excluding, where applicable, delivery costs.

If the recipient of SOMECHIC products differs from the person who made the payment, the refund will be made to the person who paid for the order.

If your order contained more than one item and you do not wish to return all of them, we will refund only the amount corresponding to the returned items. Delivery costs will not be refunded, as they are fixed per order and do not vary based on the number of items purchased.

Product returns may be made as follows:

a) Free of charge in any of our physical stores, provided the return is made in the same country where the purchase was made. The refund will be issued as a store credit with no expiration date, redeemable only in our physical stores. No cash or card refunds will be made.

b) For mainland Spain and the Balearic Islands, customers may request an exchange or home return service for a fee of €5. In the case of an exchange (size or model), this fee must be prepaid via PayPal or bank transfer. For returns, the €5 collection fee will be deducted from the refund, which will be processed through the same payment method used in the original purchase.

c) For other countries or if you prefer to use your own courier, you may return items at your own expense. We will not accept packages sent “cash on delivery.” SOMECHIC will not be responsible for loss, delay, or misdelivery of returned items; therefore, we recommend using registered mail or a courier service with delivery confirmation.

The right of withdrawal applies only if SOMECHIC products are returned in the same condition as received — unused, with original packaging, tags, and accessories. For jewelry and accessories, the security seal must remain intact. Returns that do not comply with these terms will not be eligible for a refund and will be sent back freight collect.

We will determine whether returned items meet the required conditions. You are responsible for any decrease in the value of the goods resulting from handling other than that necessary to establish their nature, characteristics, or functioning. Products that are damaged, incomplete, used, or soiled due to customer negligence will not be refunded and will be returned at your expense.

Refunds will be processed as soon as possible, and always within 14 calendar days from the date SOMECHIC was informed of your decision to withdraw from the contract. However, SOMECHIC may withhold the refund until we have received the goods or until proof of their return has been provided, whichever comes first.

You may exercise your right of withdrawal by sending any clear statement expressing your decision to withdraw from the contract.

The right of withdrawal does not apply in the following cases:

1. Customized Products: No right of withdrawal applies once production has begun. Personalized products include any item customized at the user’s request (e.g., engraved initials). Standard customization options such as color, size, or pattern do not qualify as personalization.
2. Hygiene Products: For health and hygiene reasons, underwear and swimwear that have been unsealed after delivery cannot be returned.

SECTION 9 – PRODUCT AVAILABILITY

You acknowledge that SOMECHIC products offered in our online store are subject to stock limitations. All orders are subject to availability. If any product becomes unavailable after an order has been placed, we will inform you as soon as possible so you can cancel your order if desired.

Product prices are those displayed on our website at any given time. SOMECHIC reserves the right to modify its product offerings at any time without prior notice. Such changes will not affect confirmed orders for which a Shipping Confirmation has already been issued.

SECTION 10 – PURCHASE PROCEDURE

The following procedure applies to purchases made through the SOMECHIC website:

The user must access the online store section of the SOMECHIC website, where products available for purchase are displayed, including:
a) Product description, reference, size, features, colors, composition, and photograph.
b) Unit price.
c) Shipping costs.
d) Offer validity conditions, if applicable.

After selecting the desired SOMECHIC products, the user must add them to the shopping cart, indicating the desired quantity. Once all products have been added, the user can view a purchase summary and confirm by clicking “Buy,” where the following details will appear:
a) Product.
b) Description.
c) Add to Favorites.
d) Quantity.
e) Unit Price.
f) Total Price per item.
g) Total purchase price.
h) Shipping costs and return policy.

If the user has a promotional code, it must be entered at this stage to apply the corresponding discount.

Next, the user must provide personal details. Registered users will log in with their credentials, while new users must create an account.

After entering the details, the user will proceed to the Shipping Details page, where they can review or modify billing and shipping information, and request an invoice if desired. Then, on the Order Confirmation page, the user will review the shipping and billing addresses, select the payment method, choose the “gift option” if applicable, write a personalized message, accept these Terms of Purchase, and click “Buy.”

Once the order is confirmed, the user will receive an email acknowledging receipt of the order and summarizing the purchase details. SOMECHIC will review the order and send a second email confirming either shipment or rejection.

SECTION 11 – SHIPPING

SOMECHIC products are shipped via courier service. Orders will be delivered within a maximum of 15 business days from the date we confirm your order.

For Spain (mainland and Balearic Islands) and mainland Portugal, shipping is free of charge.
For the Canary Islands, the shipping cost is €19.95 per order.
For Austria, Germany, Belgium, France, the Netherlands, Italy, Luxembourg, and the United Kingdom, the shipping cost is €9.95. For orders over €100, shipping is free.
For all other countries, please consult our Shipping section or review the cost at checkout.

Once your order leaves our warehouse, you will receive an email notification confirming that your order has been accepted and shipped.

Orders are shipped to the delivery address you provided during checkout. Please ensure that the information is accurate and complete. We are not responsible for undelivered orders due to incorrect or incomplete addresses.

You can track your order status via the “My Account” section on our website.

For security reasons, SOMECHIC will not ship to P.O. boxes or military bases and will not process any order if the recipient’s identity or address cannot be verified.

If you select PayPal as your payment method, once the order has been placed, no changes to the shipping address are allowed.

SECTION 12 – DELIVERY ISSUES

If the delivery period stated in the Shipping section has passed and you have not received your order, you must inform SOMECHIC of this situation.

If delivery is unsuccessful, the courier will attempt to contact you to schedule a new delivery date. If you wish to change the delivery address or method at that time, any additional costs incurred will be borne by you.

Orders that cannot be delivered due to customer inaction will be returned to our warehouse after 15 calendar days from the first delivery attempt. Once the products are returned, SOMECHIC will refund the amount of the order and the standard delivery costs. However, if you selected a delivery method more expensive than the standard option, we will not refund the additional costs. Return shipping costs back to our warehouse will be borne by you.

Upon receiving your order, please verify that all items are correct. If any discrepancy or issue exists, contact SOMECHIC via our contact form, providing your personal details and order number along with a description of the issue. We will contact you promptly to resolve it.

SECTION 13 – TRANSFER OF RISK AND OWNERSHIP

You acquire ownership of SOMECHIC products at the moment you receive the Shipping Confirmation and the products leave our warehouse. The risk of loss or damage to the products passes to you upon delivery of the order.

SECTION 14 – CURRENCY, TAXES, AND PAYMENT METHODS

All prices displayed on our website are shown in euros (€) for all countries.

In accordance with applicable law, all purchases made from our website are subject to Value Added Tax (VAT) or any other applicable tax based on the country of destination.

Under Spanish law, we are required to issue an invoice for orders exceeding €3,000 (including taxes). For other countries, the corresponding local legislation will apply.

If you are a VAT-registered entity within the European Union and hold a valid intra-community VAT number, you may be exempt from VAT (not applicable to sales made in Portugal). To apply for this exemption, you must send the relevant documentation via our contact form.

Shipping costs are added to the purchase summary before payment.

When entering the online store, we allow you to select your country of purchase so that product prices reflect your region. If you change the country at checkout, final prices and shipping costs may vary.

Product prices are those displayed on our website at the time of purchase. SOMECHIC reserves the right to modify prices without prior notice, but such changes will not affect confirmed orders with a Shipping Confirmation already issued.

SOMECHIC accepts payments by credit or debit card (Visa, Visa Electron, MasterCard, Maestro) and PayPal.

To ensure payment security, we use secure payment systems. Confidential payment data are transmitted directly and encrypted (SSL) to the financial institution. When paying via a secure gateway, the system automatically verifies that your card is enabled for Secure Electronic Commerce and then connects with the issuing bank to authorize the transaction.

Refunds are processed using the same payment method used for the purchase.

SOMECHIC complies with all regulations required by the payment systems available on our website and reserves the right to verify personal data and take necessary measures to ensure successful delivery.

SECTION 15 – RETURNS OF DEFECTIVE PRODUCTS

If you receive an incorrect or defective product, please contact us immediately (within 24 hours) through our contact form, providing details of the defect or error along with your personal information.

Claims will be handled from the same country where the purchase was made.

If you notice any issues with the packaging upon delivery, you must report this to the courier at the time of receipt.

We will carefully examine the returned product and notify you by email within a reasonable period whether a refund or replacement will be issued. Refunds or replacements will be processed as soon as possible and, in any case, within 30 days from the date you receive confirmation from us that the return or replacement has been approved.

The amount paid for defective or incorrect items will be fully refunded, including shipping costs and return postage incurred by you. Refunds will be made using the same payment method used for the purchase.

Your statutory consumer rights remain unaffected.

SECTION 16 – GIFT OPTION

We offer you the possibility to send gifts through our website. You must make the purchase as usual, select the delivery address where you want the gift to be sent, and mark the “Gift” option. You may also include a personalized message for the recipient. When this option is selected, the order will be wrapped together as a gift package.

If you provide personal data of third parties, you guarantee that you have obtained the necessary authorization for their processing. Likewise, you are obliged to inform those third parties of the terms and conditions of the data processing as stated in our Privacy Policy.

If you have received an item as a gift and wish to exchange or return it, you must follow our standard Return Policy procedure. The refund will be issued to the person who made the original purchase and through the same payment method used for that purchase.

SECTION 17 – PURCHASE LIMITS

For security reasons, you may not place orders exceeding €3,000 or containing more than 30 items within a 15-day period.

SECTION 20 – EVENTS BEYOND OUR CONTROL

We shall not be liable for any failure or delay in performing any of our obligations under a contract caused by events beyond our reasonable control (“Force Majeure Event”).

Force Majeure Events include, without limitation:

• Strikes, lockouts, or other industrial actions.
• Civil unrest, riot, invasion, terrorist attack or threat, war (declared or undeclared), or preparation for war.
• Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or any other natural disaster.
• Inability to use trains, ships, aircraft, motor transport, or other means of public or private transport.
• Inability to use public or private telecommunications systems.
• Acts, decrees, legislation, regulations, or restrictions of any government.

It will be understood that our obligations are suspended during the period of the Force Majeure Event, and we will be granted an extension of time equal to the duration of the event. We will use all reasonable means to end the Force Majeure Event or to find a solution by which we can perform our obligations despite it.

SECTION 21 – APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions are governed by Spanish law. In the event of any dispute arising from these Terms or the use of this website, the parties submit to the courts of the consumer’s place of residence.

If the user does not qualify as a consumer or user under applicable law, both parties agree to submit to the Courts and Tribunals of the city of Barcelona, Spain.
